There are a few basic components that must be proved in all product liability claims, starting with the product having caused a loss or injury. Keep in mind that the defective product carrying with it a high risk of injury does not, in and of itself, constitute a valid reason for a lawsuit. The defect itself must be the proximate cause of the consumer’s injury.
Another aspect of such suits involves proving a manufacturing or design defect that led to injury. The claimant must also be able to show evidence that the product’s dangerous quality, which led to injury, wasn’t obvious to the consumer. In addition, the consumer must have proof that the product was being used in the manner intended. Some product liability claims center additionally on failure to warn, or relevant information missing on posted warnings or labels.
